1. Identification of the owner

In compliance with the duty of information established in Article 10 of Ley 34/2002, de 11 de julio, de Servicios de la Sociedad de la Información y de Comercio Electrónico (LSSI-CE) (Law on Information Society Services and Electronic Commerce), the following identifying details of the owner of the website (hereinafter, the "Site" or the "Service") are set out:

2. Purpose and acceptance

This Legal Notice governs access to, browsing of, and use of the Site. Mere access to the Site and/or the use of any of its services confers the status of user and implies full and unreserved acceptance of each and every one of the provisions included in this Legal Notice in the version published at the time of access.

The relationship between the owner and the user arising from the use of the Site does not in any case constitute a partnership, association, mandate, employment relationship, agency relationship, or any other relationship different from the one described herein. The user undertakes to make diligent use of the Site and the services in accordance with the law, good faith, public order, and this Legal Notice.

3. Applicable regulations

The Service is governed, among other applicable regulations, by the following:

  • Reglamento (UE) 2016/679, General de Protección de Datos (RGPD) (General Data Protection Regulation, GDPR).
  • Ley Orgánica 3/2018, de Protección de Datos Personales y garantía de los derechos digitales (LOPDGDD) (Spanish Organic Law on Personal Data Protection and Guarantee of Digital Rights).
  • Ley 34/2002, de Servicios de la Sociedad de la Información y de Comercio Electrónico (LSSI-CE) (Law on Information Society Services and Electronic Commerce).
  • Real Decreto Legislativo 1/2007, Texto Refundido de la Ley General para la Defensa de los Consumidores y Usuarios (TRLGDCU) (Consolidated Text of the General Law for the Protection of Consumers and Users).
  • Ley 7/1998, sobre Condiciones Generales de la Contratación (Law on General Contracting Conditions).
  • Directiva 2011/83/UE, on consumer rights.

4. Description of the service

InterviewCrusher is a job interview simulator based on artificial intelligence. The user provides their résumé and a job posting, and the Service generates a simulation in which the AI acts as both recruiter and coach. The Service also incorporates neural voice features (text-to-speech / TTS) and voice dictation (speech recognition / STT) to enrich the practice experience.

5. Nature of AI-generated content

The user expressly acknowledges and accepts that the recruiter and coach figures constitute a simulation generated by artificial intelligence and not the intervention of real persons. The content produced by the AI may contain errors, inaccuracies, or incomplete or outdated information.

Consequently, the content of the Service does not constitute professional, employment, legal, or any other kind of advice, nor does it represent a guarantee of being hired or of success. The practice carried out through the Service does not guarantee any outcome in real selection processes. Any decision the user makes on the basis of the generated content is their sole responsibility.

6. Position regarding Reglamento (UE) 2024/1689 (AI Act)

The owner expressly declares that the Service is a voluntary practice tool that the candidate themselves uses on themselves and for their own benefit, without producing legal effects on the user or significantly affecting them in a similar manner.

The Service is not a system used by employers to evaluate applications or to make decisions regarding hiring, promotion, termination, or task allocation. Therefore, the owner understands that the Service does not constitute a high-risk AI system of those provided for in Annex III of Reglamento (UE) 2024/1689, and is subject to the transparency obligations applicable to interaction with AI systems under Article 50 of said Regulation, clearly informing the user that they are interacting with an artificial intelligence system.

7. Registration and age of use

To use the Service, the user declares and warrants that they are of legal age (18 years or older) and have sufficient legal capacity to accept this Legal Notice. Access credentials are personal and non-transferable, with the user being responsible for their safekeeping and confidentiality, as well as for all activity carried out with them.

The owner reserves the right to refuse, suspend, or cancel accounts in the event of improper, fraudulent, or unlawful use, or use contrary to this Legal Notice, without this giving rise to any right to compensation in favor of the user.

8. Limitation of liability

To the maximum extent permitted by applicable law, the owner shall not be liable for damages or losses arising from the use of the Service or the inability to use it, from errors or inaccuracies in the AI-generated content, or from the decisions the user makes based on such content.

The provisions of the preceding paragraph do not exclude or limit the owner's liability for willful misconduct, gross negligence, or for damage caused to the life, physical integrity, or health of persons, nor any other liability that cannot be excluded or limited under applicable law, in particular under Articles 82 and 86 of the TRLGDCU.

The owner shall not be liable for breaches arising from force majeure or unforeseeable circumstances, under the terms of Article 1105 of the Código Civil (Spanish Civil Code), provided that the owner had adopted the reasonable security measures required according to the state of the art.

The Site may contain links to third-party sites. The owner assumes no responsibility for the content, policies, or operation of such sites. Likewise, the owner shall not be liable for any improper, unlawful, or negligent use the user makes of the Service.

9. Intellectual and industrial property

All intellectual and industrial property rights in the Site and its contents (texts, design, source code, interfaces, graphics, logos, as well as the "InterviewCrusher" brand and distinctive signs) belong to the owner or to third parties who have authorized their use, and are protected by applicable national and international regulations.

The reproduction, distribution, public communication, transformation, or any other form of exploitation, in whole or in part, of the Site's contents is prohibited without the prior written authorization of the owner. Use of the Service does not grant the user any right over such elements.

10. Partial invalidity (severability)

If any clause or provision of this Legal Notice is declared null, invalid, or unenforceable, in whole or in part, by a competent authority, such declaration shall not affect the validity of the remaining provisions, which shall continue to be fully effective and binding. The affected clause shall be interpreted or, where applicable, replaced by another valid one that most closely approximates the purpose pursued by the original.

11. Notifications

For the purposes of this Legal Notice, all communications between the owner and the user may be made through the Site's contact form or by the means the owner makes available from time to time. Notifications from the owner to the user may also be made by publication on the Site itself or, where applicable, through the email address provided by the user.

12. Modification of the terms

The owner reserves the right to modify this Legal Notice at any time and without prior notice, as well as the presentation, configuration, and contents of the Site, in order to adapt them to legislative, case-law, or technical developments. The current document shall remain accessible on the Site at all times, duly dated and versioned, with the "Last updated" date determining the applicable version.

13. Applicable law and jurisdiction

This Legal Notice is governed by Spanish law and by the applicable European Union regulations. For the resolution of any dispute that may arise from access to or use of the Site, the parties shall submit to the jurisdiction that corresponds under applicable law, without this entailing the imposition on the consumer of a jurisdiction other than the one legally corresponding to them.

Prior to judicial proceedings, a user who has the status of consumer may resort to alternative dispute resolution mechanisms for consumer disputes, in particular the Sistema Arbitral de Consumo (Consumer Arbitration System), where applicable.
